Richland County Stormwater Management

Proposed Changes to the Richland County Storm Water Ordinance

Richland County is currently operating under its second five-year National Pollutant Discharge Elimination System (NPDES) permit to govern stormwater quality in County jurisdictional areas. DHEC issued the permit and it is effective from September 11, 2006 through September 10, 2011. This reissued permit also covers the Town of Arcadia Lakes and City of Forest Acres, for NPDES Phase II regulations. These regulations are a Federal and State requirement pursuant to the Clean Water Act.

The changes to Chapter 26 (Land Development) of the County’s Code of Ordinances are needed to support several programs developed by the Department of Public Work’s Stormwater Management Division in conjunction with complying with the Corrective Action Plan and reissued permit requirements. Some of those programs are:

  • Updated Stormwater Management Plan
  • Delegated Qualified Local Program (QLP) for plan reviews, inspections, etc
  • Pesticide, Herbicide and Fertilizer Control Program
  • Illicit Connection, Improper Disposal, Illegal discharge and Illegal Dumping Control
  • Sanitary Sewer Regulatory Program (SSRP)
  • Industrial and High-risk Runoff (IHR) Control Program
  • Stormwater Infrastructure Inspection and Maintenance
  • Stormwater Pollution Prevention Plans (SWPPPs)
  • Spill Prevention Control and Countermeasure (SPCC) Plans
  • Road Runoff Management Program
  • Sampling and Monitoring Program, etc.

The proposed Ordinance reflects components of the developed programs for their effective implementation and to reflect currently effective permit requirements. Some of the proposed Ordinance changes are an enhancement to already existing language on the books.

These changes will benefit Richland County’s efforts to improve water quality, will serve as an added measure to protect the environment, and will support compliance with the County’s National Pollution Discharge Elimination System (NPDES) Permit.

In between February 24th and May 29th, 2009, Richland County had accepted written public comments for the Council amended storm water ordinance. To Date:
This ordinance received first reading by County Council on October 21, 2008. It had a public hearing on February 24, 2009, and received second reading (as amended) at that time. County Council plans to hold a second public hearing prior to giving the ordinance third reading. Council also requested to obtain recommendations from Development Round Table and hold four public forums before third reading.
